Dear friends,

This month, HaMoked filed five petitions to the Israeli High Court of Justice (HCJ) on behalf of Palestinians demanding family unification in the Occupied Territories.

A decade ago, there were tens of thousands of such families, in which a foreign spouse lived in the West Bank with no legal status. HaMoked filed hundreds of High Court petitions for family unification until, in 2007, the state announced that it would review the family unification requests of this entire population. Altogether Israel approved some 32,000 family unification applications.

New families have formed since then. Israel has again frozen the processing of requests for the past ten years and only grants family unification in exceptional humanitarian cases – and the ability to live with one's spouse and children does not constitute humanitarian grounds! As a result, thousands of spouses of residents of the OPT are considered "illegal aliens" in their own homes, with the threat of deportation constantly looming over them.

 

Over the next month we will file another 13 petitions in the hopes of both obtaining legal status in these 18 individual cases, and changing Israel's policy to recognize the basic right to family life.

New Law Restricts Palestinians' Access to the High Court of Justice

Family unification is one of the few issues that remain at the HCJ. The Administrative Courts Law went into effect this month, moving most judicial review of Israeli behavior in the OPT from the HCJ to the Jerusalem District Court.

 

This is another step in this government's creeping annexation of the West Bank, attempting to erase the distinction between the State of Israel and the territory it administers under belligerent occupation.

 

Last year, HaMoked filed 190 petitions to the HCJ. From now on, most of these cases will have to be filed with the District Court and we are now prepared to do so.

 

This new law will not deter us in our efforts to defend Palestinians' rights and to raise a principled voice regarding Israel's obligations to respect human rights and international law.

חברות וחברים יקרים,

החודש הגיש המוקד חמש עתירות לבג"ץ בשמם של פלסטינים התובעים את זכותם לאיחוד משפחות בשטחים הכבושים.

לפני עשור, עשרות אלפי אנשים, אזרחי חו"ל במקור שנישאו לפלסטינים, נאלצו לחיות בגדה המערבית ללא כל מעמד חוקי. המוקד הגיש מאות עתירות לבג"ץ בשמם של זוגות כאלה, עד שבשנת 2007 הודיעה המדינה שהחליטה לפתוח בהליך לקראת אישור בקשותיהם לאיחוד משפחות. בסך הכל, אישרה ישראל כ-32,000 בקשות לאיחוד משפחות באותה תקופה.

אך מאז נוצרו משפחות חדשות. בעשור האחרון ישראל שוב הקפיאה את בחינתן של בקשות לאיחוד משפחות, והיא מאשרת בקשות במקרים הומניטאריים חריגים בלבד. לשיטת המדינה, מגורים משותפים עם בן או בת הזוג והילדים אינם מהווים עילה הומניטארית לאישור בקשה לאיחוד משפחות! התוצאה היא שאלפי בני ובנות זוג של תושבי השטחים הכבושים מסווגים כ"שוהים בלתי חוקיים" בביתם שלהם, תחת איום מתמיד בגירוש.
 

בכוונתנו להגיש 13 עתירות נוספות בחודש הקרוב, במטרה להשיג מעמד חוקי עבור בני הזוג הזרים ב-18 המקרים הפרטניים שבטיפולנו, ובשאיפה לשנות את מדיניותה של ישראל כך שתכיר בזכות הבסיסית לחיי משפחה.

 

חוק חדש מגביל את גישתם של פלסטינים לבג"ץ

איחוד משפחות הוא אחד הנושאים הבודדים שנותרו בטיפול בג"ץ. החודש נכנס לתוקפו תיקון לחוק בתי המשפט לעניינים מנהליים, והעביר את מרבית הביקורת השיפוטית על התנהלותה של ישראל בשטחים הכבושים מבית המשפט העליון (בשבתו כבג"ץ) לבית המשפט המחוזי בירושלים (בשבתו כבית משפט לעניינים מינהליים).
 

זהו צעד נוסף בסיפוח הזוחל שהממשלה הנוכחית מקדמת, תוך ניסיון מתמשך לטשטש את ההבחנה בין מדינת ישראל הריבונית לבין השטחים הכבושים, בהם חל משטר צבאי.

 

התגובות שקיבלנו עד היום – שאופיינו בהתכחשות שיטתית לקיומן של בעיות – מפורטות גם הן בדו"ח. המוקד ימשיך במאמציו באפיקים אלה, וכן באפיק המשפטי, במטרה לשים קץ לאפליה הבוטה ביחסן של הרשויות לנערים פלסטינים ולהבטיח שכל קטין יקבל את ההגנות להן הוא זכאי.

 

בשנה שעברה הגיש המוקד 190 עתירות לבג"ץ. מעתה, יצטרך המוקד להגיש את מרבית העתירות הללו לבית המשפט המחוזי, ואנחנו ערוכים ומוכנים לפעול בצורה זו.

 

חוק חדש זה לא ירתיע אותנו. נמשיך לייצג פלסטינים שזכויותיהם הופרו, ולהתעקש ברמה העקרונית על חובתה של ישראל לכבד את כללי המשפט הבינלאומי.

Jamal was born when his mother was in an Israeli prison. He was abandoned by both biological parents and transferred to a foster family in East Jerusalem at the age of two. His foster family turned to HaMoked in 2011 to help register the boy, who had no legal status in the world. HaMoked waged a seven-year legal battle on Jamal's behalf and in May, the Appeals Tribunal ruled that the Ministry of Interior must immediately grant Jamal permanent residency status in Israel. Earlier this month Jamal finally received his ID card.

ג'מאל נולד בכלא הישראלי לאם אסירה. הוא ננטש על ידי שני הוריו הביולוגיים, והועבר לטיפולה של משפחת אומנה בירושלים המזרחית כשהיה בן שנתיים. משפחת האומנה פנתה למוקד בשנת 2011 בבקשה לסיוע ברישומו של הילד, שגדל ללא כל מעמד בעולם. לאחר מאבק משפטי בן שבע שנים, בחודש מאי האחרון קבע בית הדין לעררים כי על משרד הפנים להעניק לג'מאל באופן מידי מעמד של תושב קבע בישראל. בתחילת החודש קיבל ג'מאל סוף סוף את תעודת הזהות שלו..
