HCJ 10327/02 - Jadala et al. v. IDF Commander in the West Bank Petition for Writ of Habeas Corpus

The petitioners seek a writ of habeas corpus directing the respondent to meet his obligation to inform the petitioners’ families where, and pursuant to which law, their relatives are being held, and, if they are being held unlawfully, that they be released. The petitioners are cousins who were arrested when they entered the West Bank from Jordan. They are not on lists of detainees and prisoners maintained by the Prisons Service, or on the lists of persons being held in Police facilities. From conversations with an official from the Kishon detention facility, HaMoked learned that the detainees were being held in a secret facility controlled by the Kishon detention facility, and that they were not permitted to meet with their attorneys. This is one of two petitions filed by HaMoked that led to the exposure of the existence of Secret Prison 1391.
