HCJ 8696/02, 10327/02 - Shahin et al. v. IDF Commander in the West Bank Respondent's Statement prior to Hearing

The respondent contends that the detention facility in which the petitioners in the two petitions are being held do not contain detainees at the present time. According to respondent, the facility, which lies inside an army base, was only being temporarily used by the General Security Service, a result of the shortage of detention facilities. The respondent mentions that the Minister of Defense declared the facility a military prison on 16 April 2002, but does not delineate the specific statutory provisions pursuant to which it had previously been operated, or explains why the declaration had been delayed into April 2002. The respondent further mentions that the facility meets all the standards applying to military prisons, and that under such circumstances, the petitions are moot and should be denied.
