HCJ 6579/08 – Quablan et al. v. IDF Commander the Judea and Samaria Area et al. Notice on behalf of the Respondent

State response in a HaMoked’s petition against exerting pressure on Palestinian West Bankers to permanently relocate to Gaza as a condition for their requests to visit Gaza. The respondents claim that due to the reality in Gaza and the security risk it poses, Israel is implementing a policy of separation between Gaza and the West Bank. This policy dictates a clear distinction between requests to settle in Gaza and requests for time-limited visits therein. Settlement requests are approved after the applicants declare they are aware that this is permanent relocation with all the ramifications thereof. Visit requests are only approved in exceptional humanitarian question.
