AP 8612 - Abu Haikal et al. v. the Minister of Interior et al. Petition for Order Nisi

HaMoked's petition on behalf of a Palestinian, born in East Jerusalem, and her three children, seeking to compel the Interior Ministry to reinstate her Israeli residency, which was revoked following an extended stay in Jordan, as well as to proccess family unification applications she submitted for her children. The petitioner lived in Jerusalem for almost ten years. After her application was denied by the Inter Ministerial Committee, and her children, who despaired of receiving status in Israel, returned to their father in Jordan, the petitioner herself despaired and returned to Jordan. HaMoked claims that the Committee ignored the humanitarian nature of the petitioner's application, and that the procedures of residency revocation must be reexamined, and finally, that the State must acknowledge the special status of East Jerusalm residents as irrevocable.
