HCJ 124/09 - Dwayat v. Minister of Defense et al. Judgment

The HCJ dismisses a petition against the security forces' decision to use Regulation 119 of the Defense (Emergency) Regulations to partially demolish an apartment building owned by the father of the assailant in the first bulldozer attack in Jerusalem in July 2008. The court rules that there is no room for intervention given that action is proportionate and for a proper aim. The court maintains that this is a partial demolition only, prompted by the need for deterrence. The court finds that the petitioner, who is not suspected of complicity in the attack, has failed to prove that the demolition would not deter potential assailants.
