Corfu Channel (United Kingdom of Great Britain and Northern Ireland v. Albania)

Judgment in the dispute between England and Albania regarding the passage of foreign ships in the Corfu Channel and the responsibility for the safety of the vessels. The International Court of Justice ruled, based on international custom, that in times of peace, countries have a right to send their ships through straits under the control of other states, even without receiving prior approval (Right of Innocent Passage - see Article 17 of the Convention on the Law of the Sea). The Court also ruled that a state whose territorial waters contain a strait or a sea passage is obligated to warn foreign ships of the anticipated dangers of passage. Unless otherwise decreed in an international convention, a coastal state cannot prohibit innocent passage in times of peace. (pp. 28-29 of the Judgment)
