Court File 3122/09 Military Prosecution v. Salem Decision

Military court accepts the military prosecution’s request to remand a defendant to custody after the HCJ procedure in his case was halted. The defendant is a Palestinian police officer who has been living in the West Bank since 1996 whom the state seeks to deport to the Gaza and is represented by HaMoked in the HCJ petition. In a bewildering decision, the military judge accepted questionable testimonies regarding the defendant’s membership in a prohibited organization. The judge also misrepresented the statements of the defendant who vehemently denied the accusation of illegal presence in the West Bank and explained that he had moved there in the framework of the implementation of the Oslo Accords when he was stationed in the West Bank, in coordination with Israel.
