HCJ 3760/09 Mahmoud et al. v. IPS Commissioner Petition for Order Nisi
HaMoked’s petition against the IPS to allow a former prisoner to visit his brother who is imprisoned in Israel. The petitioners claim that the IPS is breaching an HCJ judgment which established, inter alia, that the IPS must respond to applications within 14 days of submission. In refraining from responding to applications and permitting visits by former prisoners, the IPS is violating rights vested in the prisoners and their relatives under Israeli and international law, including the right to family life.
