CC 7798/04 - Odeh v. Ministry of Defense – State of Israel Statement of Claim
Civil claim filed by HaMoked on behalf of the family of a Palestinian who was killed by helicopter air fire on his roof at the ‘Askar Refugee Camp during Operation Defensive Shield. The Plaintiffs claim that the shooting was done in breach of the open fire regulations, without considering less extreme alternatives, as part of a planned arrest operation and that the Deceased posed no danger to the soldiers involved. Thus, the State, which bears direct responsibility for the assault on and wrongful death of the father, must pay for the significant damages caused to his heirs.
