HCJ 7232/09 Abu Salem et al. v. Military Commander of the West Bank

Military lifts ban in HaMoked’s petition to allow a West Bank Palestinian to travel abroad for business and family affairs. The petitioner was denied exit after refusing the ISA’s demand collaboration. His appeal was also denied by the military and only after an HCJ petition filed by HaMoked was the travel preclusion lifted. HaMoked stressed in the petition that the ISA’s demand and the restrictions on the petitioner’s freedom of movement and occupation were a breach of international humanitarian law which forbids the occupying power from pressuring protected residents to collaborate with it and requires their rights be safeguarded.
