HCJ 7650/09 ‘Aabdin et al. v. Military Commander of the West Bank Petition for Order Nisi

Following HaMoked’s petition to allow a Palestinian from Hebron to travel to Saudi Arabia with his wife for fertility treatments, the state permitted both to exit. When they arrived at the border, the petitioner was told by an ISA agent that he was precluded from travel. The petitioner appealed the preclusion to the Hebron DCO, but the appeal was not processed for over 5 months. In the petition, HaMoked claimed that the continued prevention of the petitioner’s travel was a serious violation of the petitioners’ rights, as protected residents, to freedom of movement, parenthood and establishing a family unit, which are anchored in international humanitarian law. Some three weeks after the petition was submitted, the state attorney’s office notified it was lifting the travel ban. Document available in Hebrew.
