HCJ 8269/09 S’afin et al. v. Military Commander of the West Bank Petition for Order Nisi

HaMoked’s petition to allow a West Bank Palestinian to travel abroad to perform the Hajj and visit family in Jordan. Despite the fact that the petitioner had confirmation from the DCO that he was not precluded from travel, he was denied exit upon arrival at the border and the military was delaying responding to the appeal he filed. The military’s conduct in this case is a blatant violation of the petitioner’s and his family’s rights to family life and freedom of religion alongside a breach of the military’s duty, as occupying power, to maintain good governance and secure a normal life for residents of the Occupied Territories, according to international humanitarian law.
