HCJ 5769/09 - Abu Al Rob et al. v. Military Commander of the West Bank Petition for Order Nisi

HaMoked’s petition to allow a heart patient to receive medical treatment in Jordan. Due to the patient’s serious conditions, his doctors refused to perform surgery in the West Bank and referred him to more advanced hospitals in Jordan. In the petition, HaMoked stressed that the military’s senseless insistence on subjecting his travel to the production of documents determining the treatment he requires is unavailable in the West Bank severely violates the petitioner’s right to freedom of movement, health and receipt of medical care. This refusal is a breach of the military’s duty as occupier under international humanitarian law to see to the normal lives of the protected residents under his responsibility.
