HCJ 660/88 - “In’ash al-Usra” Association et al. v. IDF Commander in the Judea and Samaria Area Judgment

Judgment in a petition by an association promoting the welfare of Palestinian families and women which runs a professional training centre; a girls’ boarding school; a nursery school; a museum and an archive – to cancel a military closure order for its premises valid for two years. The petition is partially granted. The Court holds that a basic tenet "which must guide sovereign policy in a held territory, is the desire to best allow the regular course of daily life," and that educational and charitable institutions may naturally promote its achievement. The Court rules the two-year closure order is excessive, and that legally, it should have first been examined whether a shorter closure would have sufficed to achieve deterrence.
