HCJ 2006/97 - Janimat et al. v. OC Central Command Judgment

The High Court of Justice rejects the petition against the demolition of an assailant's family home. The court dismisses the petitioners' claim that the identification of the assailant was inconclusive, and lists the evidence underlying this finding. Justice Cheshin, in a stern minority opinion, holds that the petition should be granted given that the demolition of the home constitutes punishment of the assailant's relatives who are not purported to have known about the attack. The principle whereby "every man must pay for his own crimes" should be read into Regulation 119 of the Defense (Emergency) Regulations, particularly in light of Basic Law: Human Dignity and Liberty.
