CC 9327/04 - Masri et al. v. The State of Israel Statement of Claim

HaMoked's tort claim on behalf of the family of the assailant in the attack at the Sbarro restaurant in Jerusalem in 2001, whose home was demolished by the military, causing considerable damage to property. The plaintiffs claim that the demolition was carried out without a demolition order and without a hearing, as required by law. Moreover, aside from the demolition itself, which is prohibited under international law as collective punishment and reprisal against protected persons and their property, the soldiers also caused extensive damage to structures, vehicles and fruit trees near the demolished house, for which the state must compensate the plaintiffs.
