CC (Jerusalem) 7646/95 - Udwan v. The Israel Defense Forces et al.

Claim filed by HaMoked following abuse of a UNRWA employee and resident of Qalandiya refugee camp. Soldiers abused the Plaintiff after he refused to throw a gas grenade into a house in the camp. The Plaintiff was injured by a gas grenade being fired, which caused him mental and physical pain and anguish, permanent disability and financial damages. The Defendant claimed that the Plaintiff had violated curfew (a claim which did not appear in the Statement of Defense) and that he was shot because he had attempted to grab the weapon of one of the soldiers who pulled his car over for examination. HaMoked's request to receive the investigation file was denied under the claim that it had been closed for lack of public interest and that the documents it contained had were eliminated.
