CC (Jerusalem) 4209/96 - ‘Abdallah v. The State of Israel

Claim filed by HaMoked in a case where a Palestinian was shot and injured while driving through an intersection. The shots were fired by a soldier who was standing in the vicinity. The shooting resulted in an injury to the Plaintiff's leg. He was hospitalized for a lengthy period of time, was determined to have a permanent orthopedic disability and could not continue to work in his profession as a plasterer. Despite the fact that the car passengers were questioned in the Civil Administration, a military police investigation was not opened. The claim attributes to the Defendant and/or its agent negligence due to the unjustified shooting which also violated the open-fire regulations. The case was settled and the State paid the Plaintiff NIS 160,000.
