CC (Jerusalem) 13428/96 Asfour v. Tal
Claim filed by HaMoked in the case of the beating and injuring of a Palestinian by Border Police officers. The Plaintiff was taken by a patrol to a hiding place. He was beaten all over his body, his nose was broken and then he was left. Following a complaint filed by HaMoked, the Defendants' commander sentenced the two to a few days' detention. The criminal proceeding opened against Defendant 2 resulted in his conviction of assault causing material injury, however, despite the Court's ruling that the circumstances of the offence were grave, he was sentenced to only five months' imprisonment to be carried out in community service. Without having presented a defense, Defendant 2 was ordered to pay the amount mentioned in the claim. Defendant 1 reached a settlement with the Plaintiff.
