HCJ 9390/04 - Qawasme et al. v. General Security Service Petition for Order Nisi and Interim Order

Petition by HaMoked, together with other human rights organizations, against the use of torture in the interrogation of a Palestinian detainee by the GSS [later known as ISA]. In a hearing on an earlier petition, which dealt with the refusal to let the detainee meet with his attorney, it was noted that he was tortured at the beginning of the interrogation. At that hearing, the State Attorney's Office refused to make a commitment - and the court did not insist - that torture would not be used during the interrogation. Following the filing of the present petition, the State Attorney's Office informed that the GSS stated that it did not intend to use physical force in subsequent interrogations of the detainee.
