CC (Jerusalem) 13054/04 - Hallaq v. Schoenberg et al.
Claim filed by HaMoked against the State and the commander of the Qalandiya checkpoint in the matter of a Palestinian who returned from Jerusalem following an operation on his hand and wished to cross the checkpoint. The claim states, inter-alia, that the soldiers at the checkpoint abused their authority in taking the law into their hands and using excessive force against the man with no reasonable grounds; that the State refrained from taking precautions to prevent attacks on Palestinians at checkpoints from recurring; and that in deciding to close the investigation without charging any of the persons involved, the State led other soldiers to conclude that attacking Palestinian is permissible.
