CC (Jerusalem) 20074/96 - Ismaail v. The State of Israel

Claim filed by HaMoked in a case where a Palestinian woman was hit in the leg by a plastic bullet shot by the military. The woman and her four-year-old son, were on their way to their home in the 'Askar refugee camp in Nablus. As a result of the incident, the Plaintiff was hospitalized for an extended period of time and part of her calf muscle was amputated. She continued to undergo treatments after her release from the hospital and was determined as having permanent orthopedic disability. The claim attributes to the Defendant and/or its agents, the soldiers, inter-alia, negligence manifested in the unjustified shooting of the plastic bullet, while endangering life, in violation of the open-fire regulations and while the soldiers faced no danger. The claim was settled and the State paid the Plaintiff, NIS 68,000.
