PP (Haifa) 598/05 - Samara v. Commander of Kishon Detention Center Detainee’s Petition

Petition by HaMoked objecting to the holding of a detainee at the interrogation wing of the GSS [later known as ISA] in the Kishon Detention Center without having a record of his presence in the facility, in harsh conditions in violation of law and of his lawful rights. Detainees have the right to have their place of detention clearly known to all. The failure to record a detainee in his place of detention infringes his and his family’s fundamental rights. Shortly before the hearing on the petition, the detainee was moved to Megiddo Prison. For the court’s decision on the petition, in which the judge sharply criticizes the respondent’s actions in this matter, see Linked Items.
