CC (Jeruslaem) 8750/97 - Amarneh v. The State of Israel

Claim filed by HaMoked in a case where a Palestinian was hit in the head by a rubber bullet while walking in the center of the village with his friend. The Plaintiff underwent an operation and was hospitalized for a few days. As a result of the hit, the Plaintiff suffers from chronic headaches, fainting and loss of memory. He was determined to have permanent disability due to the absence of bone in the skull and post-traumatic injury. The injury impaired his ability to take up university studies as he had planned. No Military Police investigation of the incident was opened. The claim attributes to the Defendant and/or its agents, the soldiers, inter-alia, unjustified use of rubber bullets. In its response, the Defendant claimed that the Plaintiff took part in stone-throwing, was hurt as a result of a fall and that the rubber bullets were shot into the air.
