HCJ 9332/02 - Jarar et al. v. IDF Commander in Judea and Samaria Petition for Writ of Habeas Corpus

HaMoked's petition for a writ of habeas corpus instructing the Respondent to carry out its duty and inform the Petitioner's family where he is being held and under what legal provision; and, if he is being held illegally – order his release. Despite the Respondent's obligation to inform of the whereabouts of a detainee without delay, by the time the petition was filed eight days had gone by with no notification. The petition stresses that the control center charged with locating detainees and providing information to their families and relevant organizations repeatedly failed to do so at that time. Following the petition, the Respondent gave notification of the detainee's whereabouts and the Court ruled that he must pay costs. See linked items.
