CC (Jerusalem) 22850/97 - Abu Issa et al. v. Levy et al.

Claim filed by HaMoked on behalf of the relatives and the estate of a young Palestinian from Nablus who was shot and killed by a military officer in 1995.On his way home, the young man walked close to a military jeep and the Defendant, who was inside it, fired a few shots before and during his descent from the jeep, without using his rifle sights. The Defendant and another soldier noticed the severe wound to the young man's head, but left the area without providing help. His death was pronounced a short while later. Following HaMoked's appeal, a Military Police investigation was opened. It concluded in the Defendant's being charged with failing to provide medical assistance to an injured person. The claim attributes to the Defendant negligent, unjustified shooting, without the use of rifle sights and in violation of the open-fire regulations. The State was claimed to be liable vicariously. The case was settled and the State paid the Plaintiffs NIS 50,000.
