Safe Passage between the Gaza Strip and the West Bank - Position Paper
In this position paper HaMoked details both planned and existing restrictions imposed on movement of Palestinians between the West Bank and Gaza. HaMoked notes that the West Bank and the Gaza Strip form a single territorial unit, according to both the HCJ’s ruling and the agreements between Israel and the Palestinians, including the interim agreement of 1995 and the safe passage agreement. Any restriction of free movement between the West Bank and Gaza is therefore unlawful, unless passage through Israel involves danger to state security or public safety. HaMoked calls on all sides to immediately renew free movement between the West Bank and protect, in the framework of the arrangement to be established, the integral nature of the territories.
