A and others v. Secretary of State for the Home Department [United Kingdom]

A judgment canceling section 23 of the Anti Terrorism Crime and Security Act, which empowers the British Secretary of State for the Home Department to declare a foreign national "suspected of involvement in international terrorism" and hold him in detention indefinitely, even if that person may not be removed from the UK for legal or practical reasons. The British House of Lords ruled that this section violates articles 5 and 14 of the European Convention on Human Rights (ECHR) as it is disproportionate and discriminatory on the basis of nationality. The Court also cancelled the order declaring a state of emergency in the UK and its derogation from article 5 of the ECHR.
