Following a petition filed by HaMoked, a Palestinian woman belonging to the “second HCJ population” received a visitor’s permit to the Territories which also allows for a relatively long stay therein. The Petitioner entered the Territories in 1993 with a visa issued by the Interior Ministry’s bureau in East Jerusalem and has remained there ever since with her husband and children. The Respondent has long claimed that the Petitioner did not belong to the “second HCJ population” since she had not proven her “center of life” was in the Territories. However, contrary to the Respondent’s erroneous claims, “center of life” in the Territories was never a criterion for granting a permit for permanent residency; this due to the military’s policy to allow only short intermittent visits as well as its deportation policy.
