CC (Jerusalem) 2900/98 - Birawi v. The State of Israel

Claim filed by HaMoked due to an injury caused to a Palestinian pedestrian who was hit by a live bullet fired from a military vehicle. The Plaintiff was diagnosed with a fractured hip; he was hospitalized for a few days and his leg was put in a cast for three months during which he did not work. The Military Police investigation was negligently run and the testimony of the deputy commander of the company was collected only a year and half after the incident. The claim attributes to the Defendant and/or its agents, the soldiers, inter-alia, negligence for the unjustified use of live fire while endangering human life. The Defendant claimed that the military force which was in the area did not use live bullets and did not cause the injury. For the judgment rejecting the claim see linked items.
