CC (Jerusalem) 4545/98 - Abu Fara v. The State of Israel

Claim filed by HaMoked due to an injury caused to a Palestinian, both of whose legs were hurt. The Plaintiff saw a young man wounded and unconscious near his house. He tried to get him into a truck which was parked nearby. It turned out that there were soldiers in that truck. They stormed the Plaintiff and when he tried to escape, shot and hit him. The Plaintiff underwent several operations, was hospitalized for a lengthy period of time and now suffers difficulties walking and functioning. His working capacity was severely impaired and he was determined to have a permanent disability due to his injury. The investigation was closed under the claim that the soldiers could not be found. According to the Military Advocate, a record was found according to which the Plaintiff was shot after having thrown stones at the military. The claim was settled and the State paid the Plaintiff NIS 200,000.
