HCJ 9169/07 - Taqatqa et al. v. Commander of the Army Forces in the West Bank Petition for Order Nisi

HaMoked's petition regarding holding conditions and periods in its incarceration facilities. The Petitioners and others have been held at the Eztion facility for over 21 days, one of them for almost two months. HaMoked claims that the conditions at the facility are unacceptable and do not conform to the standards of international law: detainees report of overcrowding, shortages of food, hot water and hygienic products, no access to toilets and more. The petition argues that the army consistently violates security legislation, international humanitarian and customary law and the principles of Israeli constitutional and administrative law in regards to conditions in the temporary holding facilities.
