AP 1028/07 Mustafa et al. v. Minister of Interior Petition for Order Nisi
Petition filed by HaMoked to award permanent residency to the sons of a resident of Israel who is chronically ill and needs her children's care. The Petitioner and her children returned to East Jerusalem in 1995 and her residency was reinstated. Her application for family unification with her husband was approved and he entered the gradual procedure. Their minor children received permanent residency, but the adult children's applications were denied. They have been living in East Jerusalem for over 12 years and know no other life. They are the main breadwinners for their parents and another brother who suffer from various medical conditions and need their help. The State's refusal to approve their application is a severe violation of the Petitioners' rights to health, bodily integrity, dignity and family life.
