HCJ 268/08, Abu Kweidar et al. v. GOC Southern Command et al. Petition for Order Nisi
HaMoked's petition to allow an Israeli citizen from Nevatim to visit her spouse who resides in Khan Yunis in the Gaza Strip. The Petitioner comes under the "divided families procedure" according to which spouses from divided families may remain in the Gaza Strip subject to renewable entry permits. Following a new procedure, the Petitioner left the Gaza Strip to renew her passport, as a valid Israeli passport is now a condition for renewal of the permits. The army has refused to allow her to return to her family in Gaza since 2007, for security reasons.
