HCJ 2087/10 Faraj et al. v. Military Commander in the West Bank Petition for Order Nisi and Request for Urgent Hearing

HaMoked’s petition to revoke a deportation order against a West Bank Palestinian and to release him from detention pending deportation lasting over 5.5 years. The petitioners argue that the continued deportation of the Palestinian who, as a child moved to Jordan from the West Bank to which he returned as an adult and where he started a family and the non revocation of the deportation order disproportionately harm the petitioner and constitute breaches of the military commander’s duties under Israel and international humanitarian law. The petitioners stress that no judicial review took place during the petitioners’ detention, and that he should no longer be held in detention awaiting deportation to Jordan, which would object to his return as he has no legal status therein.
