HCJ 3911/10 Bardawil et al. v. Military Commander in the West Bank et al. Amended Petition for Order Nisi
HaMoked’s amended petition to allow a West Bank Palestinian to return home from Gaza with his family. The original petition did not include the father who also found himself stranded in the Gaza Strip. In the amended petition HaMoked argues that the Palestinian who is married to a Gazan and has been visiting her and their young children in Gaza for years, has now been forced by the military to pledge not to return to the West Bank. The petitioners stress that preventing the family’s travel and forcing the father to sign an undertaking not to return home are a breach of the military commander’s duties under Israeli and international humanitarian law.
