HCJ 5314/08 - Jarusha et al. v. Military Advocate General Petition for Order Nisi

HaMoked's Petition to instruct the Military Advocate General to immediately decide whether to prosecute those responsible for the killing of a Palestinian from Tulkarm. HaMoked asserts that although the Palestinian had been killed by illegal shooting by soldiers, seven years have already elapsed, and none of those involved has yet been charged; that the delay in the exercise of authority may frustrate the uncovering of truth and harm the substantive rights of the deceased and his family. HaMoked notes that the conduct of the Military investigative and prosecuting authorities in the case seems to suggest that extraneous considerations are involved, such as an attempt to conceal flaws in the investigation or to burden and harass a Palestinian victim.
