HCJ 6845/05 - Commander of the Military Forces in the West Bank v. President of the Military Court of Appeals for Judea and Samaria and the Gaza Strip et al. Judgment
Judgment in a petition by the military commander in the West Bank against the Military Court of Appeals' decision to reject his appeal against the Military Court's decision to release an administrative detainee. The petition is granted. The justices rule that the military commander presented the military courts with substantive current information pointing to a higher level of threat than the one earlier known. The Court adds that the threat arising from the material justifies extending the detention by three months, during which, the petitioner should consider alternatives to administrative detention.
