HCJ 5148/08 - The Association for Civil Rights in Israel v. The Chief of General Staff – Lieutenant General Ashkenazi et al. Judgment

Judgment in the petition by the Association for Civil Rights in Israel to order the military to remove the northern Dead Sea checkpoint and cancel the ban against West Bank Palestinians' passage to the northern Dead Sea beaches inside the West Bank. The petition followed, inter alia, the brigade commander's statement to reserve duty officers, that the checkpoint was erected because of the damage to the Jewish settlements' income from Dead Sea bathers, when Palestinians also use the beaches. The petition is dismissed. The military changed the checkpoint's use to security checks only, and the brigade commander received clarification that the checkpoint purpose and operation stem from security considerations.
