HCJ 8567/15, 8782/15 - Halabi et al. v. Commander of IDF Forces in the West Bank Judgment

Rejection of two petitions submitted by HaMoked against the State's intention to demolish the home in Sudra of the assailant in a stabbing attack on October 3, 2015 in the Old City of Jerusalem. Regarding one of the petitions, submitted on behalf of the family, the Court rules that the purpose of the demolition is deterrent, and not punitive, "even if it is undisputed that there is often harm to people who are not involved in terrorist activities". Regarding the second petition, submitted on behalf of the Palestinian Labor Union, which claims ownership of the property, the Court ruled that "there is no obligation to prove that the terrorist who lived in the property, together with his family, did so while owning it", and that the family has had a connection to the house for many years.
