HCJ 2828/16 Abu Zeid et al. v. Commander of the Military Forces in the West Bank et al. Decision

Decision by the President of the Court to reject HaMoked's request to expand the panel and discuss the principled question of the use of Regulation 119. The request was submitted as part of HaMoked's petition against the state's intention to demolish the family home of the suspect in a stabbing and shooting attack in the Old City of Jerusalem. The President rules there is no instability in precedent justifying a panel expansion, which would mean issuing an order nisi in all ongoing cases until the present one is decided.

Supreme Court President Naor rejected HaMoked’s motion for a hearing on the general issue of punitive demolition before an expanded panel: “I have not been persuaded that there is at present instability in the case law to such a degree as warrants the expansion of the panel”
