Every person has the right to travel freely within his country: HaMoked petitioned the HCJ to instruct the military to allow five documentarists from Gaza to go to the West Bank to complete a documentary film project about Palestinian theater

In June 2010, five filmmakers, bearing Palestinian press credentials, began filming a documentary about the history of Palestinian theater in the Occupied Territories. So far, they filmed three theater groups in Gaza, interviewing among others, actors, directors, and theater critics. The project is scheduled to continue in the West Bank.
 
On July 18, 2010, the filmmakers applied to the Israeli military, through the Palestinian Civilian Committee, requesting to go to the West Bank to continue filming. The military did not reply. The filmmakers contacted HaMoked, which then transferred their application to the Coordinator of Government Activities in the Territories. Five months and three reminders later – all without reply, on January 10, 2011, HaMoked petitioned the High Court of Justice.

In the petition, HaMoked requests the court to order the military to permit the five documentarists to go from Gaza to the West Bank to complete their project. HaMoked reminds that every person has the right to travel freely within his country, and also that Gaza and the West Bank form a single jurisdiction under the Oslo Accords. HaMoked also notes that this is a blatant violation of the petitioners' rights to freedom of creative expression and to culture – recognized in international human rights law and Israeli law.
