Wrongfully and without proper notice: the military demolished tonight a family home in the West Bank, without bothering to respond to HaMoked’s objection in the matter

On July 27, 2017, the military announced it intended to demolish a house in Kobar Village, Ramallah District, where lived an assailant who committed an attack against Israelis in the settlement of Halamish on July 21, 2017, and has been in detention from then on. In the two-story home lived the assailant’s parents and unmarried siblings, as well as his married brother, his pregnant wife and their infant daughter. The family members were notified they could file an objection to the intended demolition, and so they did via HaMoked on August 1, 2017.

On August 16, 2017, at 4:00 a.m. – despite the fact that the military had yet not delivered its final decision on HaMoked’s objection – military forces arrived at the family home and completely demolished it.

The family home was punitively demolished without exhaustion of all proceedings, without giving the family the opportunity to petition the High Court of Justice (HCJ) to try and avert the threat, and without giving them ample warning and sufficient time to prepare.

Therefore, HaMoked sent the military a stern protest letter on August 16, 2017, demanding an explanation for the military’s outrageous conduct, which defied the principles of natural justice and turned an entire family homeless before their matter has been fully reviewed.
