HCJ 289/09 'Attar et al. v. the IDF et al. Petition for Writ of Habeas Corpus

HaMoked petitioned the HCJ on behalf of 15 Palestinians arrested in the Gaza Strip during Operation Cast Lead – the army refused to provide details about the circumstances of their arrest and place of detention. HaMoked demands information regarding dozens of other Palestinians – the army refuses to provide any information about these individuals as well, nor will it confirm that they are being held. It is the basic right of a detainee that his arrest and place of detention be known. The realization of this basic right is necessary for the fulfillment of additional rights, such as right to counsel and to intervention concerning incarceration conditions. Such information and the measures associated with it also form part of the rights of a detainee's family.
