HCJ 2786/09 - Salem et al. v. Military Commander for the West Bank Petition for Order Nisi and Urgent Application for Interim Order

HaMoked's petition to prevent the forcible transfer of a Palestinian police officer from Beit-Sahur to the Gaza Strip due to an error in the registration of his address. The petitioners claim that the forcible transfer of the petitioner, a father of small children lawfully living in the West Bank since 1995, is extreme and unreasonable. Furthermore, the petitioner works as a police officer in the Palestinian Authority, and his transfer to the Gaza Strip endangers his life and tears him from his family and the place he chose as the center of his life. Forcible transfer of protected residents of an occupied territory is prohibited under international humanitarian law.
