HCJ 2786/09 - Salem et al. v. Military Commander for the West Bank Respondent's Response

Respondent's response in HaMoked's petition to prevent the forcible transfer of a Palestinian police officer from Beit-Sahur to the Gaza Strip due to an error in the registration of his address. In his response the respondent claims he has security information indicating inter alia that the petitioner is a Tanzim operative and was involved in a shooting against a military base. The respondent further claims that his inquiries indicate the petitioner would not be in danger if he is deported to the Gaza Strip. The petitioner, who moved from Gaza to the West Bank in 1995, never received a permit for a set duration of stay, and the military therefore claims that he has been present in the West Bank for all these years unlawfully, and his deportation is justified.
