HCJ 5829/09 Mansour et al. v. Military Commander of the West Bank et al. Petition for Order Nisi
HaMoked’s petition to allow a woman who is originally from the West Bank but living in the Gaza Strip with her family to visit her brother who suffers from a severe head injury and assist in his rehabilitation. The petitioners claim that the military is delaying a relevant response to the clearly humanitarian application. In so doing, it is violating the petitioners’ right to freedom of movement and family life. The military is also violating the right of transit to which the petitioner is entitled under international law. Document available in Hebrew.
