HCJ 7970/09 Abu Khalf et al. v. Military Commander of the West Bank Petition for Order Nisi
HaMoked’s petition to allow a Palestinian from Hebron to travel to Jordan to bid farewell to his father who is on his deathbed. Despite the father’s dire condition, the military delayed answering for a long time and the father meanwhile passed away. Following his death, HaMoked was forced to amend the petition and request the son be allowed to grieve for his father with his family. The petitioners claim that the military’s delays in processing the petitioner’s request constitute a grave breach of good governance and the rights of the petitioner and his father to family life as protected civilians under international law.
