AP (Jerusalem) 952/02 - Abu Gwella et al. v. Minister of Interior et al. Response on behalf of the Respondent

The respondent agrees to an interim order prohibiting the deportation of the petitioners until final decision in HCJ 4608/02. The respondent contends that the birth of a minor outside of Israel, and the failure to submit a request to register him at birth, justify a thorough examination of the matter, as is done in the case of requests for family unification; that the cases in which requests to register residents’ children who were born abroad were handled as if they were born in Israel were done in error, and were not based on ministry policy; and that limiting Government Decision 1813 to requests submitted for couples is contrary to its security objective, which also relates to minors who will later become adults.
